1. Area of application

1.1    The following data privacy statement applies to the use of the wiha.com website and the services provided via the website. This website is a service provided by Wiha Werkzeuge GmbH, Obertalstrasse 3-7, 78136 Schonach, Germany, info.de@wiha.com, as the body responsible as per Art. 4 EU General Data Protection Regulation (GDPR). You can contact our Data Protection Officer at GDPR_UK@wiha.com or using our postal address and adding the words "Data Privacy".

1.2    The protection of your personal data is important to us, particularly in relation to upholding personal rights when processing and using this information. You will find information on how we collect personal data when you use our website below. Personal data are all data which can be related to you personally, such as your name, address, email addresses and user behaviour.

 

2. Automated data acquisition and processing by the browser

2.1    As with any website, our server automatically collects the following information in server log files on a temporary basis. Your browser transmits the data unless you have disabled transmission. If you wish to view our website, we collect the following data, which we require for technical purposes, so we can display our website to you and ensure its stability and security (legal basis: Art. 6 (1) lit. f GDPR):

 

  • IP address of the computer requesting connection
  • File enquiry from the client
  • The http response code
  • The Internet page where you clicked on a link to visit us (referrer URL)
  • The time of the server request
  • Browser type and version
  • The operating system used by the requesting computer

 

There is no personal data-related evaluation of the server log files. This data cannot be correlated to specific persons for the provider's use at any time. This data is not combined with any other data sources.

2.2    This website uses Google Analytics, a web analysis service belonging to Google Inc. ("Google"). Google Analytics uses "cookies", text files that are stored on your computer and that permit analysis of website usage. The information that the cookie generates about your use of this website is normally transferred to Google in the USA and stored there. However, if IP anonymization is activated on this website, Google shortens your IP address within a member state of the European Union or within another state which has signed the European Economic Area Agreement prior to transmission. A full IP address is only transferred to a Google server in the USA and shortened there in exceptional cases only. Google will use this information to evaluate your use of the website, compiling reports on website activity for the website operator and providing them with other services relating to website activity and internet usage.

According to Google, under no circumstances will the IP address provided by your browser for Google Analytics be linked to other Google data.

You can prevent cookies from being stored by using a corresponding setting in your browser software; however, be advised that you may not be able to make full use all of this website’s functions in such case. This website uses Google Analytics with the extension "_anonymizelp()." Consequently, IP addresses are only used in shortened form and can thus prevent direct personal references. If the data collected about you relates to you personally, it will be immediately excluded and the personal data will be promptly deleted.

We use Google Analytics to analyse the use of our website and improve it on a regular basis. The statistics we collect enable us to improve our online service and make it more interesting for you as a user. Google is subject to the EU-US Privacy Shield in the exceptional cases where personal data are transferred to the United States, www.privacyshield.gov/EU-US-Framework. The legal basis for the use of Google Analytics is Art. 6 (1) Sentence 1 lit. f GDPR.

 2.3    In addition, this website uses Matomo, an open-source software for the statistical analysis of visitor access, for the purpose of reach measurement, needs-based design and continuous improvement of the Internet offering. We use Matomo based on our justified interests (i.e. interest in the analysis, optimization, and economic operation of our online offer according to Section 6 (1) letter f of the GDPR). The information concerning your use of this Internet offer will be stored on our own web server in Germany and not passed on to third parties. This IP address is immediately anonymized after processing and prior to its storage.

 

3. Collection and processing of data provided on a voluntary basis

3.1    General contact

If you provide us with personal data by email or on our website (first name, surname, email address, postal address), you generally do so on a voluntary basis. This data will be used for the purposes of fulfilling obligations related to contractual relationships, processing your enquiries or your orders and for our own market or opinion research and own promotional activities using post and email.

It will not be used in any other way; in particular, it will not be forwarded to third parties for the purposes of advertising, market and opinion research. We delete the data arising in this context when we no longer need to store them or we limit their processing if there is a statutory obligation to retain them. The legal basis in this case is Art. 6 (1) lit. b GDPR or Art. 6 (1) lit. f GDPR.

3.2    Newsletter

You can give your consent to subscribe to our newsletter, which we use to inform you about our latest offers. The acquired goods and services are specified in the declaration of consent.

We use what is known as a double opt-in process for subscription to our newsletter. This means that once you have registered, we will send you an email to the email address that you indicated to ask you to confirm that you would like to receive the newsletter. If you do not confirm your subscription within 24 hours, your information will be blocked and automatically deleted after one month. We will also save the IP address that you used and the time when you subscribed and when you confirmed subscription. This process is designed to verify your subscription and any possible misuse of your personal data.

Your email address is the sole required field to send you the newsletter. Any other, separately marked data that you provide are on a voluntary basis and are then used to address you personally. Once you have confirmed subscription, we will save your data for the purpose of sending the newsletter (legal basis is Art. 6 (1) Sentence 1 lit. a GDPR).

You can withdraw your consent for the newsletter being sent and unsubscribe from the newsletter at any time or send an email to Newsletter@wiha.com to declare withdrawal.

3.3    Online shop

If you wish to order from our online shop, you need to give the personal data which we require to handle your order to conclude the contract. The fields required to process contracts are marked separately; any other information you provide is voluntary. We process the data that you provide to handle your order. In doing so, we may forward your payment details to our company's bank or an online payment service that we use. The legal basis for this is Art. 6 (1) Sentence 1 lit. b GDPR.

You need to create a customer account to purchase items from our online shop. We can save your details to this account for other purchases at a later date. If you create an account under "Login", the data that you provide will be saved but consent can be withdrawn. You can delete all other data, including your user account, in the customer area at any time. The legal basis for this is Art. 6 (1) Sentence 1 lit. b GDPR.

We may also use the data that you provide to inform you of other interesting products in our portfolio or send you emails with technical information.

Your data will only be used where necessary for the existing customer relationship. Notwithstanding, we are obliged to store your address, payment and order data for a period of ten years due to requirements under trade and tax laws.

3.4   Competitions

 We will also use your data (name, contact data) for competitions for the purpose of informing you of winners (Art. 6 (1) lit. b GDPR) and advertising our offers by post (Art. 6 (1) lit. f GDPR) or by email with your consent (Art. 6 (1) lit. a GDPR). You will find more information in the conditions of entry for the competition concerned.

 

4. Transfer to third parties

4.1    If you have provided us with personal data, as a basic rule, this data will not be disclosed to third parties. It will only be disclosed

 

  • If you have given your consent (see Item 3.2). You will be informed of the recipients or categories of recipient if your data are collected.
  • To sub-contractors who receive the data necessary for fulfilling orders and who use it in an appropriate way to process your enquiries, orders and use of our services.
  • To external service providers as part of contracted data processing as per Art. 28 GDPR. We have carefully selected these service providers. They are obliged to comply with our instructions and GDPR provisions and undergo inspection on a regular basis.
  • To comply with legal obligations to supply data to authorities entitled to receive such information.

 

4.2    Social plugins are used on this website. Social plugins are web applications which link this website to selected social networks. Your IP address and user data for the social network concerned may be transmitted to the social network via this link. You will find more details about the social plugins used in Item 6.

 

5. Cookies

5.1    This website uses cookies. Cookies are small text files which are stored locally in your Internet browser's temporary memory. The following types of cookies are used on this website. Their scope and mode of operation are explained below:

  • Persistent cookies (see 5.3).

 

5.2    Transient cookies are automatically deleted when you close your browser. These particularly include session cookies. Session cookies store what is known as a session identifier that can be used to correlate different requests from your browser during the shared session. 5.3    Persistent cookies are automatically deleted after a specific time period, which may vary, depending on the cookie. You can delete cookies in your browser's security settings at any time.

 5.4    You can configure your browser settings as required and decline to accept third-party cookies or all cookies, for example. We point out that you may not be able to use all functions on this website if you do decline.

 5.5    We use the Cookie Consent application by Silktide (Silktide Ltd, Brunel Parkway, Pride Park, Derby, DE24 8HR [UK]) on our website. This is a plugin which can be used to obtain consent for the use of cookies and/or tracking technologies. Cookie Consent also logs your IP address. 6. Social networks, marketing tools

You will find links to the social network Facebook and other marketing tools which establish a link to different social networks. Observe the following information on data protection:

 6.1    This website also uses the Custom Audiences remarketing function provided by Facebook Inc., 1601 Willow Road, Menlo Park, California, 94025, USA ("Facebook"). This allows website users to be shown interest-based advertisements ("Facebook Ads") as part of their visit to the Facebook social network or other websites that use the feature. We wish to show you advertisements that are of interest to you to make our website more interesting for you.

Facebook is certified under the Privacy Shield framework and thus offers a guarantee that it complies with European data protection legislation.

 Your browser automatically establishes a direct connection to the Facebook server due to the marketing tools used. We have no influence over the extent and further use of the data that Facebook collects when this tool is used. We hereby inform you of the extent of usage that we are currently aware of: Thanks to the inclusion of Facebook Custom Audiences, Facebook receives the information that you have accessed the page in question on our website or have clicked on one of our ads.

 If you are registered with a Facebook service, Facebook can correlate the visit with your account. Even if you are not registered with Facebook or have not logged in, there is a possibility that the provider will obtain and store your IP address and other identifying features.

The legal basis for processing your data is our legitimate interest in analysing usage behaviour and optimising our web page or our advertising (Art. 6 (1) Sentence 1 lit. a GDPR). You will find more information on how Facebook processes your data at https://www.facebook.com/about/privacy.

6.2    This website also uses the remarketing function provided by the online advertising service Google AdWords, which can be used to show you advertisements that will interest you. We wish show you advertisements that could be of interest to you to make our website more interesting for you. To do so, statistical information is gathered about you, which our advertising partner then processes. Such adverts can be identified by the "Google adverts" heading in the advertisement concerned.

 When you visit our website, Google is informed that you have accessed our website. Google uses a web beacon to add a cookie to your computer to receive such information. The data specified under Item 2.1 of this declaration are transmitted. We have no influence over the data collected. We are not aware of the full extent of data collection or how long the data are stored. Your data are transmitted to the USA, where they are evaluated. If you are logged in to your Google account, your data can be directly correlated with your account. You must log out if you do not wish your data to be correlated with your Google profile. You can prevent Google AdWords cookies from being installed in different ways: a) by making suitable settings in your browser software. 6.3    This website also uses the online marketing tool DoubleClick by Google. DoubleClick uses cookies to show ads relevant to users, improve campaign performance reports and prevent a user from seeing the same ads more than once. Google uses a cookie ID to log which ads are shown in which browser and is thus able to prevent them from being shown more than once. DoubleClick can also use cookie IDs to log what are known as conversions, which bear reference to ad requests. This is the case, for instance, if a user sees a DoubleClick ad and accesses the advertiser's website with the same browser and makes a purchase from said website at a later stage. Google states that DoubleClick cookies contain no personal information.

You may limit or object to its processing and have the right to data portability. Under Art. 77 GDPR, you also have the right to submit a complaint to a supervisory authority if you consider the processing of your personal data to be in violation of these regulations.

If your consent is required for processing (see Article 6 (1)(a) or Article 9 (2)(a) GDPR), you also have the right to revoke consent at any time. This withdrawal of consent has no impact on the legality of data processing activity up to the point in time when consent was withdrawn.
